His evidence at the Court of Appeal in London was described by Chris Daw QC, acting for the appellant as 'deeply unsatisfactory and not of
a kind to be expected from professional witnesses, attending to calmly and dispassionately assist the court. Characterised by a dismissive,
arrogant, evasive, confrontational, adversarial, inconsistent, vague, unreliable and overly defensive approach throughout. Mr Smith equally
descended into advocacy and case theory rather than answering questions' -
Any person who would remotely consider Phil Smith as their defence solicitor should proceed with extreme caution. Being prosecuted
is one of the most stressful times that anyone and their family will experience. A defendant would want to know their solicitor is someone
who they can trust, would leave no stone unturned, not see them as a ‘cash cow’ and fight to win.
